    When you are working for a large(r) corporation, where all fees (including EAD/AP) are paid for by the company, who pays for the MTR?

    I was under the impression that the employer pays for the filing, attorney, etc. fees, am I wrong?


    Depends on ur employer. Usually after AC21 - it is obvious that there is no fee involved and many companies hire you after ac21 because they do need to deal with stuff like this.

    Your employer ONLY needs to give a letter as per the AC21 rule and thats it.

    I just logged in thinking that by Monday, we July 2nd filers wud be getting receipts. But after flipping the pages back on this forum, I saw that the Monday was indeed the previous one. This is indeed misleading. After seeing the ongoing tussle between buddyinus and Srikondo, I realised Buddyinus is right. Whats wrong in whatever he's saying??? The purpose of this thread is to discuss about the so called Monday's receipts. But since that Monday is gone, looks like u r fighting over nothing. How dare u warn anybody on this thread.     I suggest that you write at least two articles. First one should focus on our problems and costs involved at each stage for the current 5-7 years waiting period. A lot of guys out there against immigration do not currently know exactly how tuff it is these days to get a visa and come to US. Just imagine if somebody came to US on a student loan and was not able to get a job because of these visa problems as has started to happen over the last couple of years, how much financial burden he will have and how long it will take him to pay off these loans. explain how visa applicants are harassed buy the consulates, USCIS/DHS/DOS, lawyers, employers just because they can. Had everyone who came to US to study or work on his/her own merit been given a green card like visa as and when they wanted it, he/she would not be exploited, they would compete with any american citizen for a better pay (taking away the argument from the anti-immigrants that we are displacing the citizens by being underpaid). This I think would have taken away the argument that we are over populating the US or that we are immigrants for ever (not assimilating in the mainstream) because then we would be part of the mainstream and those who do not want to live in US forever (a significant number of people...leading to reduced immigration) could go back when they wanted. Look for all the problems we have to face on a day-to-day basis and ask whether we are asking more than some basic human rights and are we wrong in asking for these rights. Isn't it also one form of injustice when we are paying for medicare/social security without getting any benefits? Isn't it injustice when we cannot progress in our careers when we are stuck in this endless and ever increasing GC delays? Isn't it injustice when we are equated with the illegal immigrants? Isn't it injustice when we are asked to renew our status by paying ever increasing fees and endless documentation when there is no need unless one has left the country on his own and wishes to return? Does the country really need skilled immigrants and if it does why can't it allow them to live with some basic human rights and dignity. By denying the new immigrants these rights, dignity is the US promoting new-age slavery and forcing even the legal immigrants into shadows and back alleys of the society? Explore why some legal immigrants have to resort to illegal status (school going kids, family life, friends...age at which they migrate changes their social circle) when they cannot stay in status by legal means.

    Once you have explored and educated your article readers about our situation, they will have a better understanding of what we are requesting the US govt is lot illegitimate and may even encourage some illegal immigrants into going the legal way.

    I did not see MS in any discipline.

    They had PhD CS also; my friend got PhD from there.

    They also had something like a CS diploma (don't remember details). They had 10 (??) theoretically sound courses. Students in most US schools will not be able to handle these courses.

    However, course content is not the only strength of US Education (all levels). Something else (which is hard to enumerate and quantify) happens outside the classes. But it does not happen to everyone: some are not receptive and others don't run into it!

    Yes, TIFR is a very good institute, especially in Physics and Mathematics (and CS is a mathematics discipline).

    Couldn't agree more - especially about paying for ANY college here vs. in India.

    I studied in IIT (B.Tech), got M.S. and Ph.D. from here and now a professor. My observations/opinions are as follows:

    1. Up to class XII, Indian schools are good. However, there are certain fundamental differences. Indian schools teach more material and sometimes more challenging material than U.S. schools. However, the majority of the students end up merely "remembering" and not learning; even in sciences. In general, an average student from an Indian school system would "know" more than an average student from an U.S. high-school, although in my view such "knowledge" (remembering something as a "data") is worthless. However, U.S. school system tends not to kill the curiosity and creativity of the students, which Indian system does. For good and brilliant students, however, there is no clear trend; you can get excellent and creative students from both systems.

    2. There are a handful of fine undergraduate institutes in India. The names comes to my mind are IITs, some RECs (Trichi used to be good), Jadavpur Univ., Roorkie, BHU, etc. (although IITs remain at a level higher than the rest). If you include maths, then count ISI's, which are better than IITs. The rest are just crappy. And I know how crappy can they be from my experience. I have the misfortune of teaching 100's of students who come here with an Anna University (or Osmania) B.Tech./B.E. degree in engineering, and knows absolutely nothing. And I am not exaggerating: they cannot write an elementary program in any language (apparently they learn something called "theoretical" computer programming in which they do not actually learn to program); does not know any mathematics (most cannot integrate x*exp(x); one student could not tell me what is f(0.7) by looking at a graph of x vs. f(x)) and cannot operate simple lab equipments. It is just unbelievable! Anyway, moving on.

    3. M.S. onwards, Indian Universities are bad. The only quality Institute in India in Engineering at the M.S. level is IISc. You have some more in other science related disciplines like TIFR (not sure if they give M.S. degree). IITs are not good at the M.S. level and beyond (in case you did not know: M.S. students in IITs are called "Matka"s and professors never grade M.S. students in the same scale with the B.Tech students in the fear that most M.S. student would then fail! And this indeed happened; true story.).

    There is indeed a severe dearth of qualified Ph.D. graduates in India. I had spoken with the director of Bell Labs in India and he finds it very difficult to find people who can work in R/D as a profession

    The basic problem is finding qualified teaching staffs. Professor's salaries, even in IITs, are about 7-10 times lower than what a qualified person with an equivalent degree currently gets in Industry. No wonder they cannot find faculty members (I have---well, at least had---an open faculty position offer from the director of an IIT; they are desperate for good persons). The compensation gap is too large, even considering nice faculty housing in a good place and good community for your family inside the IIT.

    By the way, no doubt there are crappy universities in the U.S. as well; especially at the M.S. level since there is no accreditation at the M.S. level.

    I believe so. I assume that USCIS eventually sends a letter acknowledging the revocation, but I don't know for sure.

    Even my attorney says the same thing that they do not represent any revocations and says that there will be an acknowledgment from USCIS regarding revocation.

    I have requested my old employer to provide me the I-140 revocation acknowledgment, but he denies saying he did not receive it and USCIS does not always send acknowledgments. That is his ball game, I could not poke around much.

    As you said that you applied for H1 extn in 2009 and got extended only for 1 yr instead of 3 yrs [as your I-140 was approved], this means that this yr if suppose you have to apply for H1 extn again that means again the employer has to pay around 4000$ for extn and your have to pay again around 500$ for H4 extn correct ?

Sometimes it still bothers me but I guess I need to get out of this critics and appreciations and want to concentrate 100% on agenda: Fight against injustice in AC21 implementation.

    I know things might change , i wish this law doesnt pass through at all. But in its form this is interpretation of major members and attorneys in current stage. Please correct me if i am wrong.

    I might agree with your conclusion of start date, but Now coming to to cases :

    Petetion for an employment based visa = I 140 , that were filed prior to the date of intro ( for our sake its Oct 2008 or May 15 2007 ) that were pending or approved , shall be treated as if such provision remained effective.

    An approved petition may server as basis for issuance of an immigrant visa.

    and for all people who are still in Labor stage will preserve their priority date.

    Now based on this , if you have filed an I140 before the date of enactment what ever it might one should be fine. Once dates becomes current and I140 approved one can file for 485 in previous system.

    I dont see any conclusion based on 485 is approved or not its just adjustment of status once PD become current , i think its all 140 that determines you are approved as an immigrant or not.

    Actually there are 2 sides to these questions.. (Of course I am also one of the EB3 aspirants.)

    1. What is America losing because of our prolonged wait for Green Cards?

    America would be losing on intellectual grounds. Most of the people waiting in the never-ending GC queue are ready to give up their spot, if they get good opportunities elsewhere, eg: UK, Canada, Australia, However it is not going to put a dent overall intellectual pool.

    America would be gaining in terms of revenue & employment creation:
    Filing fees, Attorney fees are the visible ones. The non-tangible ones being social security fund & medicare fund, Income tax, employer's insurance premiums. Most likely, the silent immigrant going back to his home country or another country is not going to ask for social security benefits/Medicare. Social Security in particular which is in desperate need of repairs greatly appreciates the immigrant going back.
    The wait creates lot of employment in terms of immigration personnel, attorneys, USCIS systems' maintenance. Consider this: A credit card processing bank does more checks on an individual/card while processing an authorization. What if the whole immigration system has been automated (instead of today's almost fully paper-based immigration processing)? Even with automated systems in place (eg PIMS), there are massive delays. But the complete reform would hit a huge employment soft spot. How much would it take to hook up a terminal in an overseas consulate, thru which the consulate officer can check the petition validity then & there itself, accessing it from a Centralized database? Heck they should learn it from Yahoo or Google, to access systems from anywhere in the world.


    2. How people who have green cards are contributing to the country as a whole ?
    By contributing to income tax. A person with green card is more likely to get more opportunities than a person on H1. H1 holder is constantly nagged with endless paperwork, dependencies, expiration dates. A green card holder can switch to different companies or start his/her own business, thereby earning for himself & paying more on income tax & possible his/her business tax.
    A permanent resident has already gone thru ton of checks/regulations eg: Criminal checks, medical tests. If the same tests were put thru for Americans, how many are really going to pass? Green card holders (or even H1 worker) stick to all rules, regulations, pay their bills without being a threat to American society.


    On the other hand, green card holders/H1s need not sign up for defense service selection (above the age of 24). Lost American jobs is whole different ball game.



    3. What if the whole green card process takes less than 3 years ?
    If it takes less than 3yrs, it will certainly make lot of IVians & happy, including me. But we are not in Utopian world.

    On the other hand, there will be huge influx of immigrant applications. Slowly immigration population would become large chunk in administrative areas, they may even reach Washington.
