What is the visa or immigration status of a person who has H4 visa and 485 pending (has EAD also)?
It seems banks do not understand anything other than Citizenship, GC or H status.
(1)EAD is NOT a status. Your status should be AOS, or H1B, L1, TN or whatever.
(2) I personally know more than a dozen people (including myself) who hgot mortgages, and this was not even an issue.
(3) You have a horse's ass for a lender. Just go to another bank. Countrywide is quite good, in my opinion. Go directly to them, not through a broker.

Ok now coming back to your statement. I just didnt say IIT but also REC's. REC stands for Regional Engineering Colleges (there are plenty in India) and that is not a payment seat. Education level is well maintained and by entrance examination standard, its far above GRE level. Argue me on this. I have no problems with America or any American, infact I feel America is a great first world nation and I love being working/living here.
But this doesn't mean I will say any bulllshit & non-fact thing about my motherland.
Also Gayatri one last thing or FACT in your words i tell you. The people(few Non Resident Indians, 2% i must say) like we have seen talk so much negative about their own country, but whenever they are in trouble in foreign countries, they look for immediate help from Indian Government. Almost all companies, in every field (engg, medicine, nursing, research..) hire people through contracting agencies. Most of the companies these days hire only US citizens or GC or EAD and try best not to hire H1b and if you look at their employees, it is rare to find 50% or more h1b holders.
On the contrary, outsourcing companies may have majority of their workers coming here on L1 or H1b and when such a fgee is imposed, I guess, for the biggies, it is just a small adjustment in their costs of bringing workers which they will adjust in their other expenses.
Overall, I am not sure, how much revenue such a law will generate. Will it generate enough revenue which is being claimed (600 million?)
To me, this kinda speech and trashing Indian companies and outsourcing etc... and showing that they acted on it just looks like it is pure politics to save face during the election year.

We are 6th year H1B, but we only have a PD date of 27th July 2006.
My son turns 21 on 13th January 2008. We have an I-140 pending since August 30th 2006, which is probably a good thing because I understand that it will help to "extend" my son's time, provided it is not denied. There is no valid reason why it should be, and we have not taken up Premium Processing for that very reason.
However, with this July Visa Bulletin fiasco, who knows how long it will be before our PD date will come up again (EB-3 ROW) and we can file the I-485
Thus, I am really interested in the outcome of your case and the CSPA draft you have come up with. I have registered with Expat's Voice, as per your request.

Visa Bulletin suggests that severe cut-off date retrogressions are likely to occur early in FY 2008, which starts on October 1, 2007.

** what type of action are you talking about. Who has the money to hire another lawyer to fight against these people. The only action one could have taken is to leave the company. But as a matter of fact all the desi companies are the same.
If you are talking about getting hired by big companies then tell me seriously how many companies are willing to go through the paper work and file h1-b. During the 2001 recession tell me how many big companies were hiring.
A drawback of the big companies is that if your are fired you loose your gc process, if you are working for a consulting company you have option of consulting and your greencard process is still intact.
I don't think these arguments about smartness vs luck are going to help anyone.
If EB3-I folks feel that they are stuck too long and getting green is a very high priority item, they would want to move/port to EB2. A lot of people have EB2 portability with the approved 140 and all but many have chose not to go this route for various reasons.
Is that being smart or stupid?
Some people feel they don't want to change their jobs and set their careers back. Others are just plain inertial. Still others feel its risky jumping through all the hoops all over again.
I think if you are just being inertial you are being more stupid than smart but other than that its a matter of choice.
The visa retrogression relief will happen when it happens. IV's organized efforts can't be blamed.
If we don't fight, we will not even have a fighting chance.You join IV's organized effort but don't just stop doing your own thing. As pointed out by others, individual decisions are also important and will probably make more difference to you as an individual than the collective community.

Did any of you get the same letter with the same content below .........what baffles me is the last sentence that says "The application will be reopened and the processing continued. Once the processing is completed, you will receive a notice under separate cover."

My I-485 case got reopened after being in denial status for three months............ My attorney got a letter from USCIS.

Looks like magic........Whoever has been working on my case from the past three months made a huge reversal decision in just a few hours on 05/14/2009 afternoon with atmost attention........I like this sudden surge in commitment and care on my case.......

Yes, you are right. It is from beginning of PERM.
So, total number in PERM labors are 144K. Thats good, not many.
So, so if we have 150K BEC cases also, it is 300K for primary and 600K-700K total for 485s.
The report shows 144,000 between March 28, 2005 - June 1, 2007. This is not bad as we all are thinking

When a girl comes to US for a job as a nurse and starts earning a good salary. The parents try to get some money from her. they build good house to make a show. Once the money starts pouring in, the (brother)son wants to do some business, build a house, the relatives start. My wifes relatives (dad's sisters) called up for money. " you guys are earning good in US, we want to build a house. When can you send me couple of lakhs".
I hate south indian nurses who came to US alone for jobs and more than that their parents who send them to earn money. I married a south indian nurse. The expectation from a daugther is more than a son because they tell their daughters once you become a nurse and go to US/UK or elsewhere i will start a business. "Our neighbour's daughter is in UK and they have a good house." Another great thing is once the girl is a nurse, guys come running to marry them and enjoy their life raising kids and the wife works at the hospital. I know several guys who got a green card through a nurse, works part time and take care of the kids. In that case the girl buys property at her dads house settles under her dad's wishes and should not do so when they married a person who earns the same salary as hers.
I really don't understand the meaning of marriage if its like a slavery.
My suggestion to those who are not married,
Marriage is very good if both of them know their responsibilities. Before marriage know each other for more than 3 years then get married. talk about whats their thinking about marriage. IS she going to change her last name after marriage. This seems small but the surroundings make the life miserable after some years. How are you going to control the finances etc..
As one of the old hindi dialogues, before marriage ... like moon(chand), after marriage .. like suraj (sun) and after having a baby - like a fire(juala).

USCIS currently has no accountability at all. Nor do they seem to have any clue about how many cases they have in the queue. Just see EB2-I dates for all the 12 VBs for the 2008 fiscal year: It started at 1 APR 2004 then retrogressed back steadily till it eventually became "U" just to jump back to 1 Aug 2006 for the last 3 months! Now after one whole year of processing and approving some 20-30K green cards for EB2-I it is starting at 1 APR 2003, a full year back from where it began last year!! Meanwhile they have handed out thousands of green cards to PDs in 2006 when the rule clearly states they have to clear older PDs first! Care to explain, USCIS?
I know people are sending out mails and DHS-7001 forms on their own but these individual scatter-shot attempts will all vanish in a big black abyss of USCIS bureaucracy and fall on deaf years. Only chance to instill some sense in this adhoc process seems to be if IV as a whole organization takes up this matter with Ombudsman and influential congressmen/senators like Zoe lofgren. IV had been very influential in redressing excesses by USCIS in the past - turing back July 2007 fiasco was no mean feat! Can we have some IV action item from core for this?
I'm afraid unless we do something about it as a group there is absolutely nothing to prevent USCIS from doing the same outrageous thing year after year with little fear of any retribution. We will all be practically at complete USCIS mercy!
Finally, I'm nothing but happy for those who got their GCs in this last round of "Lotto drawing" - including those with PD much later than mine - but the prospect of being stuck in a black hole called USCIS year after year scares the hell out of me!

My impression was that USCIS calculated the possible number of cases that would be ready to be assigned a visa (means all the name check and other formalities finished) , before a month and the first PD that will not get a VISA will be the cutoff date for the bulletin for that month.
If the USCSI didnt have enough applications to be assigned the VISA , then why are they so conservative in making the cutoff dates move ahead. What is the harm in pro-actively moving the cutiff dates, to amek sure no visa gets wasted. I think focussing on avoiding visa wastage itself will reduce this retrogression mess to a big extent
