Case type: H-1 approval without end-client letter
Submitted by Rajiv S. Khanna on Jan 20th 2010, Modified on Jan 20th 2010
Category: H-1 Visa
Status: H-1B approved
We have just received another H-1 approval for an end-client placement. There were two intervening vendors and the end-client declined to provide a letter stating that there is no requirement in law for them to provide any such letter. We had to get together convincing secondary evidence. I was highly doubtful we will get the approval, but we did. So, despite the January 8 memo from USCIS, there is life yet for consulting industry.

If Company B have applied change of status, You status become H1B as soon as that petition approves. In that case, you need to work for comany B on H1B status and can't continue working on L1.
Once you go out of country, you have choice of using either L1(if not expired)/H1B. If you have already done stamping for L1 visa, you don't need to stamp again. You need employer letter from L1 Employer.

I initially voted in favour of this, but on further reflection, I think this is bad policy and urge others to not support this.
Giving I-485 benefits to people without current PDs is a bad idea. It creates a class of immigrants who are neither non-immigrant visa holders (h1b) nor are they lawful permanent residents (i-551) with a set of rights that falls into neither category. The AoS pending status is intended as a short-duration temporary "gap" coverage for people who are a matter of months from having actual I-551 rights.
Essentially, this proposal aims to make every month into the July 2007 fiasco. In addition, and this is the truly horrible part of it, relieves US employers of the pressure and costs they feel now, extending H1Bs every 3 years. That means that the only allies that legal EB immigrants have (US Employers who require their services) are detached from the immigrants themselves...they no longer have a dog in the hunt, and will stop whatever pressure they are bringing to bear now upon Congresscritters and Senators to increase the number of EB visas available.
Disconnecting the interests of foreign-national employees from their US employers will weaken the political position of the foreign-national employees. We cannot vote or contribute to campaigns, our employers however, can do both. If employees are shifted to EADs and APs, with no further involvement of employers in their immigration status needed, then those employers become disconnected from the process, and the one and only ally the legal immigrant has is no longer interested. That's a horrible thing for the immigrant to advocate.
I strongly urge IV to back away from this proposal, as it is not in the long-term interests of the EB Immigrant community. I urge IV to instead focus their resources on items that will help immigrants long term, like increasing the number of EB visas available through initiatives like eliminating the DV program and allocating the visas to EB applicants.
Thanks for your insight. This is another perspective and it demands further discussion and analysis. The wait time between filing I-485 and receiving the green card is already beyond the norm and a lot of companies are aware of this. Imagine the wait times for the people who haven't yet been able to file for their Adjustment of Status. Wouldn't it help them (and their dependents) if they are at least allowed to file for their AOS? I invite the members to provide their perspectives on the issues raised by JeffDG above. Please do not attack each other. Let us fight together in lieu of fighting each other..

We are getting ready to file for another H1B extension, and based on work location, will have to file with the Vermont Service Center. The employer is NOT cap-exempt, but I have had an H1B for many years (so do not need to file for new visa). I am not sure which is the correct address for filing, though. (See p. 20, I-129 instructions.) I think we need to use:
All other I-129 Cases:
USCIS
Vermont Service Center
ATTN: I-129
75 Lower Welden Street
St. Albans, VT 05479-0001.
(Other option:
H-1B Cap Cases:
USCIS
Vermont Service center
ATTN: H-1B Cap
1A Lemnah Drive
St. Albans, VT 05479-0001.)
Can you confirm the first address (for all other cases) is correct?
Thanks!
C.

Hi,
My visa expires in May 2009. I applied for OPT and starting date will be from June 1st 2009. I want to go to India in the last quarter of 2009. How do I get a valid visa. Should I get a new F1 Visa? Please help me..
OPT is a part of F1, it is not a new status. Technically you can get a VISA stamp for your F1 during OPT, and many do get, but you need to prove "no intent to immigrate" during your VISA interview and that's harder to do when you are on OPT and working for some company.

It's not unusual for immigrant sports figures in the US to have big followings in their home countries. When Omri Casspi don's a Sacramento Kings NBA jersey this coming season, it will be extra special for millions of his fellow Israelis who are looking forward to seeing the first one of their countrymen to play in the NBA. Casspi was a star player in Israel and is a first round draft choice this year.

Some big compromises in the House version that dropped this morning. First, there will be $2525 in filing fees, $525 of which is due at the outset and $2000 of which is paid five years in to the ten year conditional non-immigrant period. That should presumably answer critics who complain that DREAM will add to the deficity. Also, conditional status is granted in two five year terms and the college education/military service requirements must be met in the first five year term in order to get the extension approved. Here is the new bill. HR6497

Some paras from Almost Everyone Lies, Often Seeing It as a Kindness (http://www.washingtonpost.com/wp-dyn/content/article/2007/02/18/AR2007021800915.html).
The perjury trial of I. Lewis "Scooter" Libby goes to the jury this week. The case speaks to several issues -- how the Bush administration deals with critics of the war in Iraq, and the games that Washington's reporters and politicians play with each other. As far as the jury is concerned, however, the case is about only one thing: lying.
One particularly well-qualified witness on this subject was not called by either the prosecution or the defense, so today we cross-examine Robert Feldman ourselves. Feldman is a social psychologist at the University of Massachusetts who studies lying in everyday life, and his findings are just the kind of thing that Libby's lawyers could have pounced on.
Feldman's experiments show that stern-faced judicial proceedings about perjury are as remote from the realities of human behavior as President Bush is from the Nobel Peace Prize. For one thing, lying plays a more complex role in human relationships than the black-and-white legal view recognizes. It is also so commonplace in everyday life that putting people on trial for lying is somewhat like putting them on trial for breathing.
Experiments have found that ordinary people tell about two lies every 10 minutes, with some people getting in as many as a dozen falsehoods in that period. More interestingly -- and Libby might see this as the silver lining if he is found guilty -- Feldman also found that liars tend to be more popular than honest people. (Ever notice how popular politicians somehow change their minds on controversial issues such as the war in Iraq at the exact moment that public opinion on those issues changes?)

Our friendly anti Jack has provided in the comments a couple of links to an intriguing story regarding Republican National Committee Chairman Michael Steele (currently embroiled in another scandal - this time involving strippers and GOP money - oy!). Steele has been one of the moderate voices in the GOP when it comes to immigration reform in the past and apparently he met with a pro-reform group called the Fair Immigration Reform Movement (FIRM). Accounts differ regarding whether Steele promised to work for immigration reform and, more specifically, help round up a second GOP Senator to sponsor the reform bill...
