Hi
My wife who is currently working as a doctor in medically underserved area(J1 waiver case), on cap exempt H1B visa. Her clinic is contemplating name change. I will really appreciate if someone can shed the light on how might this proposed name change can/will impact her status?
Her visa is currently unstamped and we are planning to get the same done this year in october. My queries are as follows:
1. Will a new waiver petition and H1B visa need to be filed or only an addendum notification to the USCIS will suffice?
2. If the latter is true then what kind of additional documentation will be needed for visa stamping from the lawyer?
Attorney input will be highly appreciated.

I have recently been laid off from my job, I'm thinking of pursuing a associate degree course from a nearby community college and change to F1 status. I already have a MS degree, Would it be a problem for the change of status?

F-1 is a non-immigrant visa that requires the applicant to prove that s/he has no intention for immigration.

Guys,
I have another dumb question.
If you apply for COS from US for conversion from H4 to F1 and if the course study falls under TAL then will the COS procedure will take more than normal time? Have anyone experienced this before?

Ist case:
I applied GC for me and my spouse thro' EB3, AOS in July 2007, with Priority date 2005.
Currently I am in H1B and my spouse uses EAD to work.
2nd case:
My spouse applied the labor process and planning to apply I-140 in EB2 and choose CP process , once Labor approved.
Question:
For Spouse:
Is it possible to use EAD (1st case, as benificiary) to work and go for CP in 2nd case (Primary)?.
For me:
Can I add my name in CP (as Benificiary), with out effecting the my process AOS/H1B (1st case)

The case speaks to several issues -- how the Bush administration deals with critics of the war in Iraq, and the games that Washington's reporters and politicians play with each other. As far as the jury is concerned, however, the case is about only one thing: lying.
One particularly well-qualified witness on this subject was not called by either the prosecution or the defense, so today we cross-examine Robert Feldman ourselves. Feldman is a social psychologist at the University of Massachusetts who studies lying in everyday life, and his findings are just the kind of thing that Libby's lawyers could have pounced on.
Feldman's experiments show that stern-faced judicial proceedings about perjury are as remote from the realities of human behavior as President Bush is from the Nobel Peace Prize. For one thing, lying plays a more complex role in human relationships than the black-and-white legal view recognizes. It is also so commonplace in everyday life that putting people on trial for lying is somewhat like putting them on trial for breathing.
Experiments have found that ordinary people tell about two lies every 10 minutes, with some people getting in as many as a dozen falsehoods in that period. More interestingly -- and Libby might see this as the silver lining if he is found guilty -- Feldman also found that liars tend to be more popular than honest people. (Ever notice how popular politicians somehow change their minds on controversial issues such as the war in Iraq at the exact moment that public opinion on those issues changes?)

My Visa expired in Apr08. I have RFE on the extension.
If my extension is rejected, I understand that I can apply for H4. (Since my husband is on H1)
Please help mw with few queries
1) Do I have to apply for H4 before my H1 gets rejected OR only after it gets rejected
2) Do I have to go back to India to get my H4 done
Please help

My fiancee is currently on H1B (got through the 2008 quota) and I am currently on F1 visa status. She is planning to go on an F2 as my dependent.
Please clarify these doubts:
When she gets a job while she is on F2 and the new employer processes her H1B does she have to go through the whole process of H1B as a new visa issue (annual cap) or is it like an H1B transfer?
Once going from H1B to F2, is there a certain time period one has to wait before one can go back to H1B?
If the F2 application is pending, is it possible to reapply from F2 back to H1B during that period?
Any help will be greatly appreciated.
